CNC LIMITED WARRANTY
 
New CNC machines sold by Phantom CNC carry a one-year warranty effective from the date of delivery. Phantom CNC Systems, LLC guarantees all new machines sold to be free of manufacturers’ defective workmanship, parts, and materials. We will repair or replace without charge, any parts determined by Phantom CNC Systems, LLC to be a manufacturer’s defect.
 

  • Should we determine that the defective item/part is damaged due to lack of maintenance, cleaning, or misuse/abuse, the customer will be responsible for the cost to replace the item/part, plus all related shipping charges.

  • This limited warranty does not apply to natural disaster, acts of terrorism, normal wear and tear, product failure due to lack of maintenance or cleaning, damage caused by accident, neglect, lack of or inadequate dust collection, misuse/abuse or damage caused where repair or alterations have been made or attempted by others.

  • Phantom CNC Systems, LLC is not responsible for additional tools or modifications sold or performed (other than from/by Phantom CNC Systems, LLC) on any Phantom CNC Systems, LLC machine.

  • Warranty may be voided upon the addition of such described tools and/or modifications, determined on a case-by-case basis.

  • Software purchased through Phantom CNC Systems, LLC is not covered under this warranty and all technical support or licensing must be managed through the software provider.

  • Normal user alignment, adjustment, tuning, and machine settings are not covered by this warranty.  It is the responsibility of the user to understand basic machinery settings and procedures and to properly maintain the equipment in accordance with the standards provided by the manufacturer.

  • Phantom CNC Systems, LLC is not responsible for lost earnings due to a machine being inoperative or in need of repair.

  • Spindles and bearings are not covered if failure is due to severe conditions or operating outside the duty cycle.

  • Parts under warranty are shipped at Phantom CNC Systems, LLC’s cost either by common carrier, FedEx ground service or a similar method.  Technical support to install replacement parts is primarily provided by phone, text or email.

  • The Labor required to install replacement parts is the responsibility of the user.

  • Phantom CNC Systems, LLC is not responsible for damage or loss caused by a freight company or other circumstances not in our control.  All claims for loss or damaged goods must be reported to Phantom CNC Systems, LLC within twenty-four hours of delivery.

  • Only NEW machines sold to the original owner are covered by this warranty. This warranty is non-transferable.  The warranty is limited and extends only to the original purchaser and user of the equipment sold.  It is nontransferable to any subsequent owner, user or purchaser of the equipment.  The protections under this Limited Warranty apply only to the original owner of the equipment.

 
 
 
 
NO RECOVERY OF CONSEQUENTIAL OR SPECIAL DAMAGES
 
Phantom CNC Systems, LLC shall not be liable for any consequential or special damages based on negligence, breach of warranty, strict liability, or any other theory, for failure to perform its obligations under this agreement.  Additionally, consequential and special damages shall be not recoverable even if the repair or replacement remedy for Phantom CNC Systems, LLC’s breach of its limited warranty fails of its essential purpose or for any other reason.
 
LIMITATION OF REMEDY
 
Purchaser’s exclusive remedy and the limit of Phantom CNC Systems, LLC’s liability for breach of the limited warranty set forth above, whether based on negligence, breach of warranty, strict liability, or any other theory, shall be, at Phantom CNC’s option, repair or exchange of the defective product with an identical or equivalent replacement product with substantially equivalent or superior specifications.
 
CHANGE TO TERMS
 
We reserve the right, at our discretion, to change, modify, add, or remove portions of this Warranty at any time.  Please check these Terms of Use periodically for changes.  Your continued use of the Phantom CNC after the posting of changes to these Terms will mean you agree to abide by those changes.

GOVERNING LAW, ARBITRATION AND JURISDICTION
These terms of Use shall be governed by and construed in accordance with the internal substantive laws of the State of North Carolina without giving effect to any principles of conflict of law and the federal laws of the United States of America. ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS WARRANTY, OR THE BREACH THEREOF, SHALL BE SETTLED BY ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR(S) MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.  YOU FURTHER AGREE THAT ANY ARBITRATION ACTION BROUGHT BY YOU ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE LIMITED WARRANTY SHALL BE FILED ONLY IN THE EASTERN DISTRICT OF THE STATE OF NORTH CAROLINA, AND YOU HEREBY CONSENT AND SUBMIT TO THE PERSONAL JURISDICTION AND VENUE IN THE STATE OF NORTH CAROLINA.
